Terms of Use

1. Acceptance of the terms

By installing or using the Pooker browser extension (the "Extension"), you agree to be bound by these terms of use (the "Terms"). If you do not accept these Terms, do not install or use the Extension.

2. Description of the service

Pooker calculates, in real time, probabilities related to Texas Hold'em poker (the probability of each hand and an estimate of the probability of winning) based on the visible cards. It is displayed as an overlay on top of the active web page. All calculations are performed locally in your browser using a Monte Carlo simulation engine. Pooker does not play on your behalf and does not make any decisions for you.

3. Eligibility and legality

You must have reached the age of legal majority in your jurisdiction, as well as the legal age required for gambling activities where you are located, in order to use the Extension. Gambling is regulated, restricted, or prohibited depending on the country and territory. You warrant that you are legally authorized to use the Extension and, where applicable, to take part in poker games where you are located. Compliance with applicable laws and regulations is your sole responsibility.

4. Subscription and billing

Access to Pooker requires a paid subscription. Two plans are available: an individual subscription to Pooker priced at €4.99 per month, or a Pack subscription granting access to all three extensions (Pooker, Spliiter, and Hoolder) priced at €9.99 per month. A free 7-day trial is offered to every new user for a product they have not already tried. At the end of the trial period, the subscription automatically renews at the price of the chosen plan, unless you cancel before the trial ends. Subscribing to the Pack automatically terminates any redundant individual subscription, with a credit applied on a pro rata basis. You may cancel at any time from your account area; cancellation takes effect at the end of the current billing period. Except where mandatory legal provisions require otherwise, no refund is granted for a period already billed. Payments are processed by our provider Stripe.

5. User account

Use of the Extension requires the creation of an account. You are responsible for the accuracy of the information provided, for the confidentiality of your credentials, and for any activity carried out from your account. The account is personal, and you agree not to share it. Notify us without delay of any unauthorized use of your account.

6. Use and user responsibility

Pooker is provided for informational, educational, and entertainment purposes. Its use is recommended in private games, with play money, or for study purposes. Real-time assistance is often prohibited by platforms and casinos, particularly in real-money play; a user who chooses to use it in that context does so at their sole responsibility and assumes the consequences (ban, suspension, loss of funds, penalties). You are solely responsible for checking and complying with the rules of each platform. Pooker is not liable in the event of a ban, account suspension, or loss of funds.

7. Responsible gambling

Gambling carries a real risk of financial loss and may lead to addiction. Pooker does not encourage gambling and does not guarantee any winnings. If you believe you have a gambling problem, we encourage you to seek help from the dedicated organizations in your country. Pooker cannot be held liable for gambling losses or for the user's decisions and conduct.

8. Nature of the tool and disclaimer of warranty

Pooker provides statistical information intended to assist decision-making; it does not constitute financial, legal, or betting advice, nor a guarantee of any outcome. The probabilities displayed do not prejudge the actual outcome of a game. The Extension depends on reading the cards visible on third-party services; no guarantee is given as to the accuracy or completeness of this detection. The Extension is provided "as is" and "as available," without warranty of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or continuously available, and we may modify, suspend, or discontinue it at any time.

9. Limitation of liability

To the fullest extent permitted by applicable law, the publisher's total liability arising from the use of the Extension is limited to the amount of the sums you have actually paid for the subscription over the last twelve (12) months. The publisher cannot be held liable for indirect, incidental, or consequential damages, in particular gambling losses, financial losses, loss of data, or loss of opportunity. Some jurisdictions do not allow certain exclusions or limitations of liability; the above limitations apply to the extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless the publisher, together with its successors and assigns, against any claim, demand, loss, or expense (including reasonable defense costs) arising from your use of the Extension, your breach of these Terms, the rules of a third-party platform, or any applicable law or regulation.

11. Non-affiliation

Pooker is an independent tool. It is neither affiliated with, associated with, sponsored by, nor endorsed by any poker platform, card room, casino, or game publisher. The names, trademarks, and logos of these third parties belong to their respective owners and are mentioned solely for identification purposes.

12. Intellectual property

The Extension, its code, its calculation engine, its interface, its content, and its trademarks are protected by intellectual property law and remain the exclusive property of the publisher. These Terms grant you no rights over these elements, other than the personal, non-exclusive, and non-transferable right to use the Extension in accordance with the Terms. You agree not to copy, modify, decompile, disassemble, or distribute the Extension, except within the limits permitted by law.

13. Termination

You may stop using the Extension and cancel your subscription at any time from your account area. We may suspend or terminate your access, without notice, in the event of a breach of these Terms, fraudulent or abusive use, or where required by law. Termination does not entitle you to a refund of amounts already paid, except where mandatory legal provisions require otherwise.

14. Amendments to the terms

We may amend these Terms at any time. The applicable version is the one published on this page, whose update date appears at the top. By continuing to use the Extension after the amendments take effect, you accept the revised Terms.

15. Governing law and contact

These Terms are governed by French law. Any dispute relating to their validity, interpretation, or performance falls within the jurisdiction of the French courts, subject to mandatory consumer protection rules. For any questions, you may contact us at support@wwcd.fr.
